MONTHLY MEMBERSHIP TERMS & CONDITIONS

PRINCIPLE TERMS

  1. This agreement commences once you have indicated your acceptance in the Declaration section of the web sign up process.
  2. Your membership starts immediately (unless you join prior to opening in which case your membership will start the day the gym opens)
  3. You will be entitled to all the rights and privileges exercisable for the Type of Membership chosen.
  4. You cannot transfer this agreement to anyone else.
  5. You manage your own account in MYFLYE, FLYEfit will not intervene in your account, you enter your details and make any amendments to your account.  You may also book classes/gym programmes and update your details

FEES AND CHARGES

  1. The Registration Fee and first month’s membership fees are collected by Credit Card/Debit Card (whichever you chose) on your membership application date.  These fees are not refundable under any circumstances with the exception of the Money Back Guarantee detailed below.
  2. Your second monthly membership fee will be collected one month after you joined, unless you joined prior to your gym opening in which case it will be collected one month after the gym opened.
  3. Your monthly payments will be deducted by the method you choose upon joining (either credit card/ debit card) You can amend your payment method in MYFLYE (please change payment details at least 72hrs before your payment is due)
  4. Subsequent  monthly membership fees will be collected monthly thereafter and  these monthly payments made are not refundable.
  5. If any monthly membership fee is returned unpaid or if any other form of payment is not honored, we will send you an email informing you of the bounced payment.  You will have 72hrs to make payment before your access is suspended.  You will be required to make payment in MYFLYE by credit card/ debit card within 21 days to reactivate access and avoid paying the reg fee of €25. Non payment will result in your account being automatically cancelled and registration fee will apply again if you wish to rejoin.
  6. All unpaid monthly fees including pause fees will be subject to €1:33 bank charges. These charges cover costs to FLYEfit for an unpaid payment.  Your bank may also charge you unpaid fees.
  7. We do not intervene in your account, you manage your own account so we can only apply for payment for a card/ bank account that you enter into MYFLYE payment details therefore unpaid fees are non refundable in any circumstance.
  1. You agree to comply with the Rules of Membership which are displayed prominently in the Club and on our website which relate to opening hours, use of facilities and your conduct. We may make reasonable changes to these Rules at any time provided that we give you advance notice of the change.
  2. We may terminate this agreement with immediate effect on notifying you if you are in breach of the Clubs Rules.
  3. Your membership will be cancelled immediately and you will have access until your next direct debit would have been due.
  4. You should also notify your bank to confirm cancellation of payment instructions.

SEPA CHANGES TO DIRECT DEBIT PAYMENTS : FROM 1ST FEB 2014

  1. From 1st Feb 2014 Flyefit will contuine to collect your Direct Debit on your payment date, however your bank will take longer to process your payment (up to 3 days) therefore your payment will come out of your account 3 days later than before SEPA came into affect.
  2. SEPA does not affect how you cancel your membership you must still cancel online 72 prior to your payment date.
  3. SEPA, the Single Euro Payments Area, is a European driven regulation which comes into affect 1st Feb 2014. Direct debits that we currently submit to Bank of Ireland under the existing IRECC scheme will be replaced with the SEPA Direct Debit scheme by 1st February 2014.The SEPA Direct Debit (SDD) scheme allows both domestic and cross-border collections to be made in euro, . Consumers are able
    to pay for goods or services throughout Europe via direct debit as easily, securely and efficiently as they do at home
  4. Terms and conditions for the consumer are standardised across all 32 SEPA countries
  5. The SEPA Direct Debit scheme covers both recurring and one-off direct debit collections
  6. BIC and IBAN are the only permissible account and bank identifiers

UPFRONT ANNUAL MEMBERSHIP TERMS & CONDITIONS

PRINCIPLE TERMS

  1. This annual membership commences once you have indicated your acceptance in the Declaration section of this web sign up process.
  2. Your membership starts immediately (unless you join prior to opening in which case your membership will start the day the gym opens)
  3. You will be entitled to all the rights and privileges exercisable for the Type of Membership chosen.
  4. You cannot transfer this upfront membership to anyone else.

FEES AND CHARGES

  1. The Joining Fee and full years membership fees are collected from you on your membership application date and are not refundable under any circumstances with the exception of the Money Back Guarantee detailed below.
  2. Renewal of a 12 Month Upfront Membership
    An email informing you when your membership is due for renewal will be sent to all 12 month upfront members, 1 month prior to the date that the membership is due for renewal. This email will detail;

    • a. The Cost of Renewal
    • b. The date of Renewal
    • c. Renewal link
  3. If your membership is not renewed by/on the specific renewal date, your membership will be deemed to have lapsed and you will not be allowed access to the club without payment.
  4. If you wish to re-join after your membership has lapsed (i.e. 30days after your renewal date), you will have to pay the registration fee and the current upfront prices that are being charged to new members.
  5. You agree to amend any change to the Members Details  and access details provided in MYFLYE.

GENERAL TERMS

  1. You agree to comply with the Rules of Membership  which are displayed on the website which relate to opening hours, use of facilities and your conduct. We may make reasonable changes to these Rules at any time provided that we give you advance notice of the change.
  2. If we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.
  3. We may terminate this agreement with immediate effect on notifying you if you are in breach of the Clubs Rules.

MONEY BACK GUARANTEE

  1. If you join the gym and change your mind you are entitled to a full refund within fourteen days of joining provided that you inform memberservice@flyefit.ie. by midnight on day 14 as per the distance selling rules.
  2. As an added member service, if you have joined in the pre-opening phase of the gym opening and change your mind you are entitled to a full refund within the first fourteen days provided that you do not use the gym at all within the first fourteen days and that you have informed memberservice@flyefit.ie by midnight on day 14.

 DAILY MEMBERSHIP TERMS AND CONDITIONS

PRINCIPLE TERMS

1 This daily membership commences once you have indicated your acceptance in the Declaration section of this web sign up process.
2. Your membership will be activated on the date you specified and is valid for one visit.
3. You will be entitled to all the rights and privileges exercisable for the Type of Membership chosen.
4. You cannot transfer this daily membership to anyone else nor transfer to another date.

FEES AND CHARGES

1. The Daily Membership fee is not refundable under any circumstances.

GENERAL TERMS

1. You agree to comply with the Rules of Membership which are displayed prominently on the FLYEfit website and relate to opening hours, use of facilities and your conduct. We may make reasonable changes to these Rules at any time.

2. We may assign the benefit of this agreement and our rights there under to a third party on notice to you. Your rights under this agreement will not be prejudiced.

3. We may terminate this agreement with immediate effect on notice to you if you are in breach of the Clubs Rules.

SECURITY:

LOCKERS

  1. Lockers are provided in all Gyms. Please ensure that you lock all belongings away securely at ALL Times! Management is not responsible for loss or theft of any items whilst on the premises.
  2. Lockers are only for the time you are in the Gym and are not allowed for overnight use.

BICYCLE RACKS

  1. There are bicycle racks in /close to FLYEfitGyms.  Use of these bike racks is at your own Risk. Security of your bicycle is your responsibility, please ensure your bicycle is securely locked at all times. Management accept no responsibility for loss or theft for your bicycle or any items linked to your bicycle whilst in or close to FLYEfit premises.
